Conditions of Use

§ 1 Validity
The following conditions apply to the sale of goods and provision of services by the company Souvenirs & trends. We only deliver to resellers , manufacturers and wholesalers. A business license is submitted.

§ 2 Our Offers
All offers are without obligation and do not undertake to accept the order.
§ 3 Prices
All prices are in EUR plus VAT valid at the time .
The prices quoted are from our warehouse plus shipping and packing. With the indication of prices is still no offer made .
The prices are net . Cash discounts or rebates without written agreement is not permitted.
§ 4 Delivery
1 The company Souvenirs & Trends delivers the goods in accordance with the agreements . If a delivery date agreed with the customer , we will keep to this schedule to the best of ability. The company Souvenirs & Trends is entitled to make partial deliveries to a reasonable extent .
2 Is the company Souvenirs & trends with a delay in the delivery , the customer must grant a grace period of at least two weeks to effect the performance . The seller is also entitled to withdraw all or part of the contract.
3 The risk passes to the buyer once the company has souvenirs & trends and the supplier over the goods to the forwarding agent or otherwise given to the delivery person or institution. The delivery is delayed for reasons for which the customer is responsible, the risk shall pass to the notification of readiness for shipment to the customer.
4 Goods can not be returned without a separate written agreement .
5 On behalf of customers goods are picked up by the customer to insure sufficient.
§ 5 defects / shortfalls
The buyer shall inspect the goods immediately upon receipt for completeness and defects . Defects or shortages must be reported within 7 days of receipt of goods . Returns will only be accepted free of charge. The shipping costs will be refunded to the buyer at legitimate defects or wrong deliveries of course . In unfree programs adopted by the consignor to pay the additional costs incurred .
Bemängelnde goods are to be sent to our approval within 14 days to us. Late submissions will not be accepted.
§ 6 Special
In the buyer -designed, or specially acquired goods and quantities , a withdrawal is excluded and obliged to accept .
§ 7 Liability and Warranty
For closeouts and special is no warranty .
The company Souvenirs & trends is not liable for any third-party rights to the customer . Rights of third parties should be touched with the purchase of goods , the customer shall be liable itself , unless that company Souvenirs & trends to the Customer and notifies in writing that the company adheres trends for souvenirs & rights of third parties.
The Customer hereby acknowledges that is exempt for rights of third parties or liability to any third party the seller from all claims .
Since both parties act commercially , the seller of the statutory warranties is freed . The Seller shall not be liable for warranties to consumers .
Products , which are sold by the seller , but are working with guarantees must be sent to the seller or work free . After factory warranty processing the goods are to be collected from the seller. For these products, the buyer has no claim to compensation .
§ 8 Retention of title
The company Souvenirs & Trends retains title to all goods delivered by it until fulfillment of all claims arising from the contract and other claims acquired by the company subsequently Souvenirs & trends against the customer in direct connection with the delivered goods , equal to whatever legal reason before . Before transfer of ownership , the customer is on the goods under retention of title have souvenir and trends with the prior written consent of the company . If third parties , in particular the attachment of the purchased item , the customer has to inform us immediately in writing and inform the third party of the title property of the company Souvenirs & trends.

§ 9 Severability
If any provision of this agreement be or become invalid, the remaining provisions shall remain valid. The parties agree to replace the invalid provision by a valid one which best meets the economic objectives of the parties . The same applies in the event of a breach of contract . Different agreements are effective only if confirmed by us in writing .
§ 10 Place of Performance / Jurisdiction
Fulfillment / place of jurisdiction is the registered office of the company souvenirs & Trends in 68723 Schwetzingen
All contracts concluded by the company Souvenirs & trends with its customers transactions are subject to the laws of the Federal Republic of Germany .
